Terms of Service
These terms cover what Hugsy promises you, what we ask in return, and the boring-but-necessary bits about subscriptions, content, and liability. Plain English. Read with your partner.
1. Agreeing to these terms
By creating a Hugsy account or using the app or this website, you agree to these Terms of Service and to our Privacy Policy. If you don’t agree, please don’t use Hugsy.
We may update these terms as the product changes. If we make material changes, we’ll notify you in the app or by email before they take effect. Continued use after that notice means you accept the new terms.
2. Who can use Hugsy
- You must be at least 18 years old.
- You must have the legal capacity to enter into a binding agreement.
- You must not be barred from using Hugsy under the laws of your country or under any previous Hugsy account termination.
3. Your account
You agree to provide accurate information when creating your account and to keep your sign-in credentials safe. You are responsible for everything that happens under your account. One account per person. Tell us immediately if you suspect unauthorised access.
4. The pair
Hugsy is a two-person app. Most of what you do in the app is intended to be shared with the one partner you’ve paired with.
- Either partner can leave or pause the pair at any time from inside the app. The other partner will be informed.
- Content you created (memories, answers, drawings) belongs to you. When the pair ends, you keep what you contributed; your partner keeps what they contributed.
- We are not able to mediate disputes between partners about what should happen to the shared timeline. Please discuss this with each other.
5. Acceptable use
You agree not to:
- Use Hugsy to abuse, harass, threaten, stalk, or impersonate anyone — including your partner.
- Upload content that is illegal in your jurisdiction or ours, that infringes someone else’s rights, or that depicts minors in any sexual context.
- Send spam, scrape the service, run automated scripts, or attempt to reverse-engineer or circumvent security measures.
- Interfere with other users, partners, or the operation of the service.
- Use Hugsy to facilitate any illegal activity.
If your partner reports that you are using Hugsy to abuse them, we will take that seriously. We may suspend or remove an account that breaches these rules.
6. Your content
You own the content you put into Hugsy — your answers, photos, drawings, messages. We do not claim ownership of it.
To run the app, you grant Hugsy a worldwide, non-exclusive, royalty-free licence to store, transmit, and display your content to you and your paired partner, and to back it up. This licence ends when you delete the content or your account, except where the law requires us to keep records.
You are responsible for the content you upload, including making sure you have the right to share photos of other people.
7. Subscriptions and payment
Free and Plus
The core daily ritual on Hugsy is free forever. Hugsy Plus is an optional subscription that unlocks extras (unlimited memories, AI-personalised questions, additional partner-privacy features). One Plus subscription covers both partners in a pair.
Billing
Plus is billed through Apple or Google depending on the device you subscribed on. They handle the payment; we receive only your subscription status. Prices may change; any change will only apply to your next renewal and you’ll be notified in advance.
Cancellation and refunds
You can cancel anytime from your App Store or Google Play subscription settings. Cancelling stops the next renewal; your access continues until the end of the current billing period. Refunds are handled by Apple or Google under their store policies.
8. Service availability
We work hard to keep Hugsy running, but we can’t promise it will be available without interruption. We may release updates, take parts of the service down for maintenance, or discontinue features. Where we can, we’ll give notice.
9. Termination
You can delete your Hugsy account at any time from inside the app. This is permanent.
We can suspend or terminate your account if you breach these terms, if your account is used for abuse, or if required by law. We will tell you why, unless we’re prohibited from doing so.
When your account ends, we delete your data on the schedule set out in our Privacy Policy.
10. Hugsy is not a substitute for professional help
Hugsy is a habit and ritual app, not therapy, counselling, medical, or crisis-support service. If you or your partner are in distress, please contact a qualified professional or, in an emergency, your local emergency services.
11. Third-party services
Hugsy uses third-party providers (described in the Privacy Policy) and may link to third-party content. We are not responsible for those services. Their terms and privacy policies apply when you use them.
12. Disclaimers
Hugsy is provided “as is” and “as available.” To the maximum extent allowed by law, we disclaim all warranties — including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any content will be retained without loss.
13. Limitation of liability
To the maximum extent permitted by law, Hugsy, its officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of your use of the service.
Our total aggregate liability for any claim arising out of or relating to these terms or the service will not exceed the amount you paid to Hugsy in the 12 months preceding the claim, or ₹5,000, whichever is greater.
14. Indemnity
You agree to indemnify Hugsy from claims brought against us by third parties because of your content, your use of the service, or your breach of these terms.
15. Governing law and disputes
These terms are governed by the laws of India. Any dispute that we can’t resolve through a friendly back-and-forth will be subject to the exclusive jurisdiction of the courts at our registered office, except where mandatory consumer-protection law gives you the right to bring proceedings elsewhere.
